Terms of Service

These Terms govern your access to and use of Caicaini (the "Service"). By creating an account or using the Service you agree to be bound by them. If you do not agree, do not use the Service.
1. The Service
Caicaini provides paid access to large language models through a web application and a terminal client ("Caicaini Code"). The Service is sold on a credit basis: a subscription grants a monthly credit allowance, and additional credits can be purchased as one-time top-ups. The credit values, model lists, and per-message rates of each plan are published at .
We reserve the right to change features, pricing, model availability, and rate limits at any time. For changes that materially reduce what an active subscription gets, we will give at least seven (7) days' notice by email and on the account dashboard.
2. Accounts
You must be at least 13 years old to create an account, and at least the age of majority in your jurisdiction to enter a paid subscription. You must provide a valid email address and keep your password confidential. You are responsible for all activity that occurs under your account.
One person, one account. Creating multiple accounts to circumvent free-plan limits or evade a suspension is grounds for permanent ban without refund. We use IP and device fingerprint signals to detect duplicate accounts.
You can close your account at any time from . Closing an account does not refund unused credits unless explicitly required by law. We retain the audit log of an account for at least one (1) year after closure for fraud and abuse investigation, after which we anonymise it.
3. Payments and credits
All prices are quoted in U.S. dollars. Crypto payments are accepted via NOWPayments and via direct manual transfer to addresses we publish at the time of purchase. Once a payment is confirmed on-chain (or, for manual payments, once an operator approves it), the corresponding credits are added to your balance and your subscription period begins.
Subscription credits are valid for the calendar month of issuance. They do not roll over. Top-up credits do not expire as long as the account is active.
Refunds. Crypto payments are non-reversible by nature; we offer refunds only at our discretion and only for a documented service failure on our side. If we approve a refund, it is paid to the same wallet the payment originated from, in the same currency, net of any network fees. We do not refund credits that have already been spent on model calls.
4. Your content and the model's output
You retain all rights to the prompts, files, and other inputs you send to the Service ("Inputs"). You grant Caicaini a limited, non-exclusive licence to process those Inputs for the sole purpose of providing the Service to you, including by transmitting them to the upstream model providers (currently Anthropic and Moonshot AI; we may add or change providers).
The text, code, and images returned by the model ("Outputs") are provided to you to use as you see fit, subject to applicable law. You are responsible for evaluating the Outputs for accuracy, originality, safety, and fitness for any purpose. AI models can produce confidently wrong, biased, or unsafe content; do not rely on Outputs for legal, medical, financial, or safety-critical decisions.
We do not train any model on your Inputs or Outputs. We do not sell or share them with third parties for advertising. See the for what we do collect and why.
5. Acceptable use
You agree not to use the Service to:
- Generate content that is illegal in your jurisdiction or in ours.
- Generate sexual content involving minors, real-person sexual content without consent, content that incites violence against a person or group, or instructions for the manufacture of weapons capable of mass harm.
- Probe, scan, or attempt to bypass the rate limits, credit guardrails, or authentication systems of the Service.
- Resell raw model access (i.e., wrap our API in your own service for third-party customers without a separate written agreement).
- Use the Service to send spam, phishing, or other unsolicited bulk communications.
- Submit personal data of third parties without a lawful basis for doing so.
We may suspend or terminate any account that we, in good faith, believe has violated this section. For severe violations we may also forfeit unspent credits and report the activity to law enforcement.
6. API keys and the CLI
Paid plans include access to programmatic API keys for the Caicaini CLI. Keys are bearer tokens — anyone holding the key can spend your credits. Do not commit a key to a public repository or share it. We will revoke any key reported as leaked. You can revoke your own keys at and we recommend rotating them at least once per quarter.
7. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Caicaini disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of the Outputs, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or available at any specific level of latency. Upstream model providers can and do have outages; we will surface those to you and reconcile credits where possible, but we are not the issuer of the underlying model and cannot guarantee its behaviour.
8. Limitation of liability
To the fullest extent permitted by law, Caicaini and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or related to your use of the Service.
Our aggregate liability arising out of or related to these Terms is limited to the greater of (a) the total amount you paid Caicaini in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.
9. Indemnity
You agree to defend, indemnify, and hold harmless Caicaini and its operators, contractors, and providers from any claim or demand — including reasonable attorneys' fees — arising out of (a) your Inputs, (b) your use of the Outputs, (c) your violation of these Terms, or (d) your violation of any third-party right, including any intellectual property or privacy right.
10. Suspension and termination
We may suspend or terminate your access to the Service immediately, with or without notice, if we reasonably believe you have violated these Terms, if your payment is reversed or charged back, or if continuing to provide the Service to you would expose us to legal risk.
You may terminate by closing your account at . Sections 4, 7, 8, 9, 11, and 12 survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the operator's registered jurisdiction, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction. Nothing in this section limits any mandatory consumer-protection rights you have under your local law.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top of this page and, if the changes affect your existing rights, notify you by email at least seven (7) days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
